BRAIN, N. Y.– A federal judge in New York sentenced a New York state jury Thursday to $2 million in prison terms for conspiring to traffic in counterfeit Viagra, the drug sold as the “little blue pill”.
The judge said the drugs had “the potential to be counterfeit and unsafe.”
In court documents, a federal judge has not announced the sentence or has any comment on the terms of the sentence.
The judge did not comment on the charges against the defendants, but did say the federal government has recovered a total of $2 million in penalties for the defendants, which is the maximum allowed by U. S. law.
The judge noted that the defendants’ sentences are for a “comprehensive” scheme to defraud the government, which includes the mail order and wire fraud offenses. The government alleged that the defendants marketed the counterfeit drugs for profit by using money allegedly made from the sale of drugs to people who were not qualified to sell the drugs. The judge said the defendants’ crimes were a crime of the United States, and had “no proven” evidence of a crime. The judge also said the government “has not proved the drug’s safety or efficacy.”
